Kyle T.H. Smith
1-888-739-8066
Kyle obtained his Bachelor of Laws from Osgoode Hall Law School in 2006 as one of the youngest students in his graduation class, having been accepted to Osgoode after only two years of undergraduate study at York University. Upon graduation, Kyle joined Strype Barristers LLP as an articling student and continued on with the firm as an associate after his call to the Ontario Bar in 2007. He joined the firm as a partner in 2011.
Kyle's practice is focused on plaintiff personal injury and medical malpractice litigation. He has appeared before the Ontario Superior Court of Justice, the Ontario Court of Appeal, and has also represented his client's interest before various tribunals, including the Financial Services Commission of Ontario.
In his young career, Kyle has already acted as counsel in precedent setting cases, including Leduc v. Roman, wherein he successfully defended the appeal of a Master's decision to deny production of a Plaintiff's facebook page. This case is now a leading authority on facebook production motions in Canada. Kyle also acted as counsel in the recent decision of Anand v. Belanger, wherein he was successful in denying a tort defendant a collateral benefit deduction for a settlement in a related long term disability action. Once again, this case is now a leading authority in Ontario with respect to collateral benefit deductions.
