- Improper diagnosis: If you have been improperly diagnosed with a condition, cancer for example, you will generally be scheduled for surgery. In a situation where a patient is incorrectly diagnosed with cancer, it is often the case that the doctors are in such a rush to get the patient to surgery that they overlook the proper testing protocols. This, then, is unnecessary and dangerous surgery.
- Missed diagnosis: A common example, unfortunately, is a missed diagnosis of breast cancer. Individuals trust a doctor to make a correct diagnosis the first time. If the breast cancer diagnosis is missed, the disease might never be caught. Or, it might be caught in Stage 3 or Stage 4 when there is less that can be done.
- Consent: If an individual is diagnosed with cancer, for example, he or she will consent to surgery. Unfortunately, if the cancer diagnosis was incorrect, the consent was made without the patient being fully and correctly informed. This can be considered non-consent, and non-consent surgery amounts to an assault.
