The Deductible

In the case of a motor vehicle accident occurring after October 1, 2003, a $30,000 deductible applies to a claim for general damages for pain and suffering. The deductible was intended to reduce premiums for insurance coverage, but this never happened. The Provincial Government is now reviewing the deductible in light of the huge profits made by insurance companies. Previous to October 1, 2003, this deductible was $15,000.

In order to submit a claim, the claimant must establish that his/her general damages have a value more than $30,000. In the cases where the general damages are assessed at more than $100,000, the $30,000 deductible does not apply.
